SUPAVAN® TERMS & CONDITIONS

These Terms & Conditions apply to reservations and purchases of SUPAVAN AIRDREAM® rooftop sleeping pods and SUPAVAN® trailers from SUPAVAN Limited (“SUPAVAN”, “we”, “us” or “our”).
1. About SUPAVAN SUPAVAN
Limited is a company registered in the United Kingdom.
SUPAVAN AIRDREAM® is a lightweight rooftop sleeping pod designed for use with suitable vehicles and roof-bar systems.
SUPAVAN® trailers are designed to provide an alternative platform for using the SUPAVAN AIRDREAM® independently of a vehicle roof.
2. Reservations
A reservation for a SUPAVAN AIRDREAM® may be made through the SUPAVAN website by paying a £100 reservation payment.
The reservation payment secures the customer’s place within a SUPAVAN production allocation and represents the customer’s commitment to proceed with the purchase of a SUPAVAN AIRDREAM® at the agreed purchase price, subject to these Terms & Conditions
The current advertised purchase price of a SUPAVAN AIRDREAM® is £4,995 including UK VAT, unless otherwise expressly agreed in writing by SUPAVAN.
The £100 reservation payment will be credited against the purchase price, leaving a balance of £4,895 including UK VAT payable before collection.
Payment of the reservation does not transfer ownership of the SUPAVAN AIRDREAM® to the customer.
3. Cancellation of a reservation
A customer may request cancellation of their reservation before collection.
Where a customer voluntarily cancels their reservation, SUPAVAN will normally retain the £100 reservation payment.
The reservation payment is intended to compensate SUPAVAN for costs and commitments associated with allocating production capacity and processing the reservation.
However, nothing in these Terms & Conditions excludes or restricts any statutory right the customer may have to cancel or receive a refund where such right cannot lawfully be excluded.
Where SUPAVAN is legally required to refund a reservation payment, the applicable statutory requirements will apply.
4. Production and availability
SUPAVAN AIRDREAM® products are manufactured in production runs.
SUPAVAN may provide an estimated production or collection date when a reservation is made. Any such date is an estimate unless SUPAVAN expressly confirms a date as guaranteed in writing.
SUPAVAN reserves the right to make reasonable changes to materials, components, dimensions, colours, finishes or specifications where necessary for manufacturing, safety, regulatory compliance or product improvement.
SUPAVAN will not make changes that materially reduce the functionality or quality of the product without informing the customer.
5. Price and payment
The advertised purchase price of the SUPAVAN AIRDREAM® is £4,995 including UK VAT, unless otherwise agreed in writing.
The £100 reservation payment is credited against this amount.
The remaining balance of £4,895 including UK VAT must be paid in full before collection.
Unless otherwise agreed in writing, the SUPAVAN AIRDREAM® will not be released until cleared funds have been received.
SUPAVAN will clearly communicate any change to the advertised purchase price before the customer becomes liable for the balance, subject always to the customer’s statutory rights.
6. Collection
SUPAVAN products are collection only.
Collection will take place from SUPAVAN’s designated collection point in Cheshire, approximately one mile from Junction 20 of the M6.
The precise collection address and collection instructions will be provided to customers when their SUPAVAN AIRDREAM® is ready for collection.
Customers are responsible for arranging suitable transportation and ensuring that their vehicle, trailer or other means of transport is suitable and legally compliant for carrying the product.
SUPAVAN does not provide delivery unless expressly agreed in writing.
7. Customers outside the UK
Customers resident outside the United Kingdom may purchase and collect SUPAVAN products from the UK.
Where a customer collects a SUPAVAN product for export outside the United Kingdom, the customer is responsible for complying with all applicable export, import, customs, VAT, taxation, registration, transport and regulatory requirements in the destination country.
SUPAVAN does not provide international delivery unless expressly agreed in writing.
The customer is responsible for determining whether the SUPAVAN AIRDREAM® and its intended use comply with the laws and regulations applicable in their country.
8. Vehicle compatibility and installation
The customer is responsible for ensuring that their vehicle, roof bars, mounting system and any other equipment used with the SUPAVAN AIRDREAM® are suitable for the product.
The customer must comply with all applicable vehicle manufacturer requirements, roof-load limitations and road-traffic regulations.
The SUPAVAN AIRDREAM® must not be used with a vehicle, roof-bar system or mounting system that is unsuitable for its weight, dimensions or intended use.
SUPAVAN is not responsible for damage arising from the use of unsuitable vehicles, roof bars, mounting systems or third-party equipment, or from incorrect installation, modification or misuse.
9. Ten-year SUPAVAN guarantee
SUPAVAN provides a 10-year guarantee covering the SUPAVAN AIRDREAM® and SUPAVAN® trailers against defects in materials and workmanship, subject to the terms of this guarantee.
Where a covered defect occurs during the guarantee period, SUPAVAN will provide repairs free of charge.
Where reasonably required, the product must be returned to the SUPAVAN base in Cheshire for inspection and repair.
The customer is responsible for the cost and arrangement of returning the product to SUPAVAN unless otherwise agreed.
The guarantee does not cover damage or deterioration caused by:
* misuse or neglect;
* accidents or impact damage;
* unauthorised modification;
* incorrect installation;
* abnormal or unintended use;
* failure to follow SUPAVAN instructions;
* normal wear and tear;
* cosmetic damage that does not affect functionality; or
* third-party equipment or modifications.
This SUPAVAN guarantee is provided in addition to, and does not affect, any statutory rights the customer may have.
10. Product condition and inspection
Customers are encouraged to inspect their SUPAVAN AIRDREAM® or SUPAVAN® trailer carefully at collection.
Any visible damage or obvious defect should be reported to SUPAVAN as soon as reasonably possible.
Nothing in these Terms & Conditions limits a customer’s statutory rights relating to goods that are faulty, not as described or not fit for their intended purpose.
11. Product use
SUPAVAN products must be used responsibly and in accordance with all instructions supplied by SUPAVAN.
The SUPAVAN AIRDREAM® is designed as sleeping accommodation and must not be used for purposes for which it was not designed.
Customers are responsible for complying with all applicable laws and regulations governing their vehicle, trailer and use of the SUPAVAN AIRDREAM®.
12. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
Subject to this, SUPAVAN shall not be responsible for loss or damage arising from misuse of the product, failure to follow SUPAVAN instructions, use with unsuitable third-party equipment, unauthorised modifications or circumstances outside SUPAVAN’s reasonable control.
Nothing in these Terms & Conditions affects the customer’s statutory consumer rights.
13. Intellectual property
All SUPAVAN® and SUPAVAN AIRDREAM® branding, designs, images, drawings, product concepts, patents, patent applications, trademarks and other intellectual property belonging to SUPAVAN remain the property of SUPAVAN Limited or its licensors.
Customers may not reproduce, copy, manufacture, modify or commercially exploit any SUPAVAN design or intellectual property without prior written permission.
14. Privacy
Personal information supplied to SUPAVAN will be handled in accordance with SUPAVAN’s Privacy Policy.
15. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these Terms & Conditions affects any mandatory consumer rights that apply in the customer’s country of residence where those rights cannot lawfully be excluded.
